1. Introduction and Acceptance

Welcome to Mother's Kitchen ("we," "us," "our"), a cloud kitchen service operating in Gurgaon, India, specializing in delivering Indian meals on a subscription basis. Mother's Kitchen is a brand owned and operated by OMGR Restaurants ("the Company"). By subscribing to our meal plan, accessing our website, mobile application, or placing an order, you ("the Customer," "you," "your") agree to be bound by these Terms and Conditions ("T&Cs"). These T&Cs constitute a legally binding agreement between you and OMGR Restaurants Management Company LLC (trading as Mother's Kitchen). Please read them carefully before subscribing.

2. Subscription Model

2.1. Plan Description: Each Mother's Kitchen subscription plan entitles the Customer to a total of twenty-four (24) meals, to be delivered over a period of four (4) weeks.

2.2. Service Days: Mother's Kitchen prepares and delivers meals from Monday to Saturday. No meals are served or delivered on Sundays.

2.3. Meal Type Schedule:

* Vegetarian Meals: Available for delivery all days from Monday to Saturday.

* Non-Vegetarian Meals: Served by Mother's Kitchen exclusively on Wednesday, Friday & Saturday only.

2.4. Meal Selection: Customers must specify their meal preference (Vegetarian or Non-Vegetarian) at the time of subscription. Changes to meal preference during an active subscription cycle are subject to availability and must be requested before cut off timings as mentioned on your subscriptions page.

2.5. Subscription Fee: The fee for the Mother's Kitchen subscription plan is as listed on our official platform at the time of purchase. All prices are in Rupees (INR) and are exclusive of GST where applicable.

3. Payment and Billing

3.1. Payment: Full payment for the Mother's Kitchen subscription cycle is required upfront at the time of sign-up. All payments are processed to OMGR Restaurants.

3.2. Non-Refundable Policy: All subscription fees paid for Mother's Kitchen services are strictly non-refundable. By purchasing a subscription, you acknowledge and agree that you are not entitled to a refund, either in full or in part, for any reason, including but not limited to:

* Unused meals within the subscription period

* Change of mind or personal preference

* Temporary absence from the delivery location (e.g., travel, vacation)

* Minor variations in meal taste, ingredients, or presentation

* Selection of vegetarian plan versus non-vegetarian plan

3.3. Automatic Renewal (If Applicable): For rolling subscriptions, your Mother's Kitchen subscription will automatically renew at the end of each cycle upon successful payment unless you cancel it before the renewal date, as per the cancellation clause herein.

4. Delivery Terms

4.1. Delivery Areas: Mother's Kitchen delivers within predefined areas in Gurgaon. It is your responsibility to confirm that your delivery address is within our service area at the time of subscription.

4.2. Delivery Timings: Mother's Kitchen will provide an estimated delivery window. However, neither Mother's Kitchen nor OMGR Restaurants is liable for any delays in delivery caused by factors beyond our reasonable control (see Force Majeure).

4.3. Delivery Instructions: You must provide accurate delivery address and contact details for Mother's Kitchen deliveries. If you are not available to receive the delivery, you may provide alternate instructions. Risk of loss or damage to the meals passes to you upon delivery at the designated address. Mother's Kitchen is not responsible for meals once they have been delivered as per your instructions.

4.4. Failed Deliveries: If a Mother's Kitchen delivery fails due to incorrect address provided by you, your unavailability, or your failure to provide access, the meal will be considered delivered and will be forfeited. No replacements, refunds, or credits will be issued for failed deliveries attributable to the Customer.

5. Customer Responsibilities

5.1. Allergy and Dietary Disclaimer: Customers are solely responsible for informing Mother's Kitchen of any known food allergies, sensitivities, or specific dietary restrictions prior to subscription. While Mother's Kitchen takes care in preparation, our kitchen handles allergens including nuts, dairy, gluten, and shellfish. Mother's Kitchen cannot guarantee a completely allergen-free environment and disclaims all liability for any allergic reactions.

5.2. Food Consumption: Mother's Kitchen meals are prepared fresh daily and are intended for immediate consumption. You are responsible for the safe storage, handling, and consumption of the meals after delivery. Mother's Kitchen is not liable for any illness or injury resulting from improper storage or handling by the Customer after delivery.

5.3. Meal Preference Responsibility: Customers are responsible for their selection of vegetarian or non-vegetarian meals. Mother's Kitchen is not liable for any dissatisfaction with meal choices made by the customer.

5.4. Account Security: You are responsible for maintaining the confidentiality of your Mother's Kitchen account credentials and for all activities that occur under your account.

6. Cancellation, Pause, and Modification

6.1. Subscription Cancellation: You may cancel your Mother's Kitchen subscription to prevent future renewals. Cancellation will not trigger a refund for the current active subscription period.

6.2. Meal Pausing: Subject to a 24-hour advance notice, you may request to pause your Mother's Kitchen meal deliveries for a maximum of one week per subscription cycle. Paused days will be added to the end of your subscription cycle. This is a courtesy service provided at the sole discretion of Mother's Kitchen and is subject to operational feasibility.

6.3. Menu Changes: Mother's Kitchen reserves the right to change the menu, including specific dishes, based on seasonal ingredient availability, quality, or operational requirements, while maintaining the overall meal type schedule (vegetarian daily, non-vegetarian on Wednesday, Friday & Saturday only).

7. Limitation of Liability

To the fullest extent permitted by Indian law, Mother's Kitchen, OMGR Restaurants, its parent companies, affiliates, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in any way connected with your subscription, even if we have been advised of the possibility of such damages. The total cumulative liability of Mother's Kitchen to you shall not exceed the amount you paid for the subscription fee for the current cycle.

8. Force Majeure

Mother's Kitchen shall not be held liable for any failure or delay in performance of its obligations due to events beyond its reasonable control, including but not limited to Unfavourable/ Unsafe Weather Conditions for our bike riders, acts of God, war, terrorism, government regulations, public health crises (e.g., pandemics), strikes, shortages of materials, power failures, or any other event that makes the performance of its obligations commercially impracticable.

9. Governing Law and Dispute Resolution

These T&Cs shall be governed by and construed in accordance with the laws of the Gurgaon/ India. Any dispute, controversy, or claim arising out of or relating to these T&Cs shall be subject to the exclusive jurisdiction of the courts of Gurgaon.

10. Amendments

Mother's Kitchen reserves the right to modify, amend, or update these Terms and Conditions at any time at its sole discretion. Any changes will be communicated to you via email or a notice on our website/app. Your continued use of Mother's Kitchen service after such changes constitutes your acceptance of the new T&Cs.
